Need suggestions on how to deal with our misbehaving neighbors?

My hubby and I bought a house last year, since we have moved in we have discovered that our neighbors SUCK!!! They park on our property and when I said something to the wife, she stated that was their land and walked off. They have also had an assortment of dogs, they keep dying in the road, they will not put them on a leash( there is no leash law here) and they come in my yard tear trash everywhere, the newest one just destroyed $300.00 in landscaping, I once again confronted the neighbor and she snapped at me and stormed off. I am so sick of these people, I called the animal control and they said because I live outside the city limits there is no leash law and the only thing I can do is shoot the dog, I really don't want to shoot this puppy. Need advice on how to deal with these rude *** neighbors. A fence wold be the practical thing to do but since this woman thinks part of my property is hers I will need to have land surveyed first and I don't have $500 right now.please help!

Actually having a survey done and putting up a fence may well be less expensive than a lawyer.


I'd say bite your tongue for now and save your money, get a reliable survey of your property (make sure she is there when is it done and most importantly make sure you know exactly where the surveyour puts the markers, just in case she moves them)


Then put up a good, 6 foot stockade fence. It may be expensive, but in the long run it will help with your peace of mind.


Either that or buy bushes with really sharp thorns and plant them closely all along the edge of your property.

Reply:As for usage of your property, call the police next time it happens, and file a report. You want to create a legal trail of paperwork as soon as possible. If you let it go, your land may be taken from you, as some states have usage laws which forfiet your property if you allow someone use of it for more than a certain time period. As other users stated before me, check your property description, and measure it out to be sure, so you'll have a valid complaint when the police show up. Tell them you want vehicles towed, and post no parking signs on that area.





As for the dog, check with your local petco, or pet store. I think I recall seeing some doggie deterrant that you can either spray, or place in your yard. If that doesnt work, pepperspray works pretty well, and can be purchased at many sporting goods stores. If THEY have homeowners insurance, make a claim, since their dog destroyed your yard.





Make sure to write a written complaint to them. In the letter, state that they are no longer to park or trespass on your property, and that they need to maintain controll over their animals. Send a copy to them, and yourselves. Dont open your copy...just retain it sealed with the postmark. Take lots of pictures, and document EVERYTHING!

Reply:make an anonymous call from a pay phone and tell the cops you know some people who are doing drugs, and where they are......(:O)))
Reply:Pull the legal description of your property from your closing documents and measure out the property boundaries yourself to prove that the property is yours.





Use a video camera when the dog is in your yard, then show the tape to prove the dog is getting into your property and damaging things.





Be polite and disarming about it. I.e. don't get confrontational. Just tell her that you understand completely that she may not have been aware that her dog was doing these things, but here's the recording to prove it. Then ask her if she can understand how you don't want the dog damaging your property.





If she will not listen to polite reason, then when you have her dog on tape doing damage, get an estimate to repair it and take her to small claims court. Ask the court for money, and to order her to keep the dog off your property.
Reply:did you not receive a survey when the property was purchased? you can look in your county's property appraiser website and it should (if it is anything liek the prperty appraiser websites i vist daily) have a photo, a GIS map, that shows the property lines. i suggest you do get a survey as soon as you have the money to do so. i know they are quite costly, but it is a good thing to have. it would solve this problem.





as for the dog, i would definitely not suggest shooting it. i am quite surprised animal control told you to do something like that when that is animal cruelty. i would keep the dog.





even if you decide to get a fence, you would most likely need a survey so that the people putting it up know where your property lines are.
Reply:When you bought your home, you should have gotten a copy of the survey. Look back at your closing papers. If not, go to a local realtor and ask them to look up your property in their plat books or on-line for you...take the plat summary (will be your property lines) and stake them out using the cooridinates from the plat to understand where your property line really is (there should also already be stakes or markers from the last survey)...THEN...send your neighbors a copy...showing them that they are illegally encroaching on your property.


THEN...understand what your local laws are on zoning, animals, etc (usually on your areas website or Chamber website)...THEN...get the police or sherrif involved..report your neighbors for any violation you can find (but please don't lie)...call your local Health Department about the dogs..the condition of the home, etc...


I think if you show these people you mean business and take a firm stand for your rights to a peaceful dwelling, you may get somewhere with these seemingly uncaring folks...
Reply:Does your state have a leash law? If so call the state or county police about the dog and see if they can help you. Find your property deed and read up until you can be sure you know where your property lines are before you take any action. A survey is expensive but guess what so are lawyers so I would try to avoid legal action if possible. Your situation may get to a point when you have no choice but to take legal action. Good luck. Oh one more thing pictures don't lie so take pictures of the neighbors poochie for the cops
Reply:Have the land surveyed, and then build a fence on your land. Then, sue her in small claims court for the cost of the fence once you can prove that they damaged your property and recoup your losses there.
Reply:How nasty of them... I agree you have to get the police involved and have complaints filed in case you need to go to court eventually. Make sure you are on your best behavior so they can't counterclaim for anything.

They don`t really care about your rights and property...I would look into getting a land survey, TRUST ME THEY SAVE A LOT OF GRIEF!! I had issues with my neighbors putting up a fence on my property and it was finally disputed with a survey....
